By submitting your cover or derivative work to us you agree to the following terms and conditions.
This agreement (the 'Agreement') is made on the date music is submitted by the Artist via this form, between the Artist and Mister Kite Entertainment Corp. ('Company', referred to hereafter as 'the vt'), a Delaware, USA-based C-Corporation. Company and Artist are sometimes referred to individually as 'Party' and collectively as the 'Parties'. The Parties agree as follows:
1. Artist Owns Their Art. The Artist is under no legal obligation to any other company, person or persons that would prohibit Artist's music submission. Artist is not signed to a record label that is not on the vt's approved list of labels. Artist is not signed to a performance rights organization that is not on the vt's approved list of performance rights organizations. Artist is legally able to submit their cover song and have it available for listening to the vt's membership community.
2. Limited Rights Granted. The Artist is submitting an original master recording of a published music composition in the vt's Active Catalog for consideration purposes as part of the vt's ongoing Cover Contest. 'Active Catalog' is here defined as being currently available to stream on the vt's music service. 'Cover Contest' is here defined as being available for private consideration by the vt's member community. The Artist retains all rights to their performance, and the music composition rights owner retains their music composition rights. No rights are granted beyond consideration purposes for the vt's Cover Contest.
3. No Obligation. The vt is under no obligation to feature or display the Artist's submitted work(s). If the Artist is chosen for a future feature, the Artist will be contacted at the address provided on this form with additional information.
4. Delivery. The Artist has provided mp3s in 320k format via the link on this form.
5. Indemnity: The Artist indemnifies and holds the vt harmless from any and all claims, liabilities and costs, losses, damages or expenses (including attorney’s fees) arising from any third party claim relating to the Artists' submission, including any and all claims to the music composition(s) and the underlying master recording(s).
Filling out this form & submission of materials indicates agreement of the above terms and conditions.
